Practicing Before EPA’s Environmental Appeals Board

The Environmental Appeals Board is an appellate tribunal established by regulation to hear administrative appeals under all major environmental statutes that EPA administers, including importantly where EPA is the permit-granting authority under the federal Clean Water Act National Pollution Discharge Elimination System (NPDES) like in Massachusetts and New Hampshire. The Board’s caseload consists primarily of appeals from permit decisions and administrative civil penalty decisions, as well as petitions for reimbursement of costs incurred in complying with cleanup orders issued under the Comprehensive Environmental Response, Compensation, and Liability Act.

The Executive Office for Immigration Review (EOIR) recently instituted a new final rule for immigration practitioners providing limited representation in matters before the immigration court. The rule went into effect on November 14th, and has immediate implications for many attorneys already providing limited immigration services, or wishing to do so in the future. Join us for a roundtable discussion featuring attorneys from both nonprofit and private immigration practice, who will explore the parameters of the new rule and discuss the opportunities, as well as potential concerns, that it offers practitioners working in a variety of legal settings.
